§ 1118 Mediated Oral Agreement Rules

Key Takeaways

  • •If you make a deal by talking (not writing), it must be recorded by a court reporter or a good audio recorder.
  • •Everyone involved must say out loud what the deal is and agree to it while being recorded.
  • •You have to say the deal is official and can’t be broken.
  • •The recording must be written down and signed by everyone within 3 days.

Example

Two friends argue over who gets to keep a shared bike. They go to a mediator and agree out loud that one friend will buy the other’s half for $50.

The mediator records their agreement. Both friends say on the recording, 'This deal is final, and we can’t change our minds.' The mediator writes down what they said, and both friends sign the paper the next day. Now the deal is official, and no one can back out.
