§ 17301 Federal Election Ballot Retention

This law says election officials must keep sealed packages of many kinds of ballots and related items for 22 months after an election, and they can only open or get rid of them if a legal challenge or criminal case starts within that time.

Key Takeaways

  • •All ballots and related papers for federal offices must stay unopened for 22 months.
  • •The list includes regular ballots, mail‑in ballots, provisional ballots, spoiled or cancelled ballots, and the envelopes that go with them.
  • •If no election contest or fraud prosecution starts within those 22 months, the sealed packages can be destroyed or recycled.

Example

A voter sends in a mail‑in ballot for a U.S. Senate race.

The election office has to store the ballot, its envelope, and any related paperwork in a sealed package for 22 months. If nobody files a contest or a fraud case about that ballot within 22 months, the office can then destroy or recycle the package.
