§ 16900 Election Appeal Rights

This law says if you lose a court case about who won an election, you can ask a higher court to look at it again. While they're deciding, the person the first court said won gets to do the job like nothing's wrong.

Key Takeaways

  • •If you lose an election case in court, you can appeal to a higher court.
  • •While the appeal is happening, the person the first court said won gets to do the job.
  • •The appeal doesn't stop the winner from working until the higher court makes a final decision.

Example

Imagine two people, Alex and Jamie, run for mayor. The court says Alex won, but Jamie thinks that's wrong.

Jamie can ask a bigger court to check the case. While they're checking, Alex still gets to be mayor and do the job.
