§ 11325 Recall Statement Mailing Requirements

When a recall election is held, the voter guide that gets mailed to voters must also include the reasons for the recall and the officer’s response, printed together and given the same importance.

Key Takeaways

  • •The recall reasons and the officer’s answer must be mailed with the voter guide.
  • •Both documents must be printed together on the same page or on facing pages and given equal prominence.
  • •If more than one officer is being recalled, each officer’s statement and answer must be printed together but clearly separated from the others.

Example

A town mayor is facing a recall. The city sends out a voter information guide to every resident before the recall vote.

The guide will have a copy of the recall reasons the petitioners filed and, if the mayor filed a response, that answer too. Both pieces will be on the same page (or facing pages) and will look equally important, so voters can see both sides before they vote.
