§ 11021 Recall Notice Service Requirements

This law says you have to give a written notice to any officer you want to recall, deliver it in person or by certified mail, and then file the original notice plus proof of delivery within seven days with the elections office.

Key Takeaways

  • •Notice must be delivered by personal delivery or certified mail.
  • •The original notice and an affidavit about how it was served must be filed within seven days.
  • •File the paperwork with the elections official, or with the Secretary of State for a state officer.
  • •You need a separate notice for each officer you want to recall.

Example

A neighborhood group wants to recall the city mayor.

They send a certified letter to the mayor saying they intend to recall him, then within a week they turn in the original letter and a sworn statement about how they mailed it to the city clerk. If they also wanted to recall the city treasurer, they'd have to send a separate notice for that officer.
