§ 10730 Special Election Procedures

This law tells how to pick and vote for a new House member when a disaster leaves a seat empty.

Key Takeaways

  • •Sets the steps for nominating and electing candidates in a special election after a catastrophe.
  • •Regular election rules from Chapter 1 still apply unless they conflict with this chapter or Section 8 of Title 2, U.S. Code.
  • •Makes sure the process is clear and consistent even when a disaster creates a vacancy.

Example

A big flood wipes out a district and the Representative can no longer serve, so a special election is held to choose a replacement.

The special election must follow the nomination and voting steps laid out in this law, and it can also use the normal election rules from Chapter 1 unless those rules clash with this law or with Section 8 of Title 2 of the U.S. Code.
