§ 89514 Retirement Credit For Leave

Key Takeaways

  • •If you take unpaid leave from work, that time doesn't count toward your retirement.
  • •If you get paid during your leave, that time does count toward your retirement.
  • •Taking leave doesn't mean you lose your retirement benefits—it just pauses the count if unpaid.
  • •If a work agreement says something different, that agreement wins (but only if the money part is approved by the government).

Example

You work for the state and take 3 months off without pay to travel.

Those 3 months won’t add to your retirement time. But if you got paid for 1 of those months, that 1 month would still count.

If such employee receives compensation during such leave of absence the time for which he receives such compensation shall be credited toward retirement. The period of any leave of absence shall not be construed as a break in the continuity of service required toward retirement. (b) If the provisions of this section are in conflict with the provisions of a memorandum of understanding reached pursuant to Chapter 12 (commencing with Section 3560) of Division 4 of Title 1 of the Government Code, the memorandum of understanding shall be controlling without further legislative action, except that if such provisions of a memorandum of understanding require the expenditure of funds, the provisions shall not become effective unless approved by the Legislature in the annual Budget Act.
