§ 89512 Employee Reinstatement After Leave

Key Takeaways

  • •If you take a leave from work (like for family or health reasons), you can get your old job back when you return, if it still exists.
  • •If your old job is gone, your boss must give you a similar job that you can do.
  • •If there’s a special work agreement that says something different, that agreement wins—but only if it doesn’t cost extra money without the government’s okay.

Example

You take 3 months off work to care for a sick parent.

When you come back, your boss must give you your old job if it’s still there. If not, they must find you another job like it that you can do.
