§ 87417 Academic Employee Reemployment Dates

Key Takeaways

  • •If a teacher quits or gets fired and then gets hired again, their new start date is when they first came back to work.
  • •If a teacher is let go because there aren’t enough students or the school stops offering a class, their original hire date stays the same.
  • •The rules are different if the teacher was rehired before July 1, 1947, or after that date.

Example

A teacher gets fired for being late too much but is later rehired.

When the teacher comes back, their new start date is the day they first returned to work, not their original hire date.

§ 87417 Academic Employee Reemployment Dates

When any academic employee shall have resigned or been dismissed for cause and shall thereafter have been reemployed by the board, his or her date of employment shall be deemed to be the date on which he or she first accepted reemployment (if reemployed before July 1, 1947) or rendered paid service (if reemployed after June 30, 1947) after his or her reemployment. When an employee’s services are terminated for lack of enrollment or discontinuance of service or are otherwise interrupted in a manner declared by law not to constitute a break in service, his or her original order of employment shall stand. (Amended by Stats. 1990, Ch. 1302, Sec. 47. Effective September 25, 1990.)
