§ 5441 School Election Ballot Retention

Key Takeaways

  • •After an election, voted ballots are kept sealed for 6 months. If no one complains or starts a legal fight in that time, they get destroyed without being opened.
  • •Ballots that were messed up or not used are also kept sealed and destroyed the same way as voted ballots.
  • •Papers like tally sheets and lists of people who got help voting are kept too, but people can look at these papers after the votes are officially counted.

Example

After a school board election, some people think there was cheating. They have 6 months to say something.

If no one complains within 6 months, all the ballots get thrown away without anyone checking them again. But if someone complains in time, the ballots are kept for checking.
