§ 5342 Election Consolidation Rules

Key Takeaways

  • •If a school or community college election happens on the same day and in the same area as another election, they can be combined into one.
  • •The people in charge of the elections can decide to merge them if they get requests from the groups involved.
  • •The requests must be sent at least 88 days before the election day.

Example

A school district and a city both have elections on the same day in November.

Instead of having two separate voting days, they can combine their elections into one. This means you vote for both school and city leaders at the same time and place. But the school and city must ask to do this at least 88 days before the election.

§ 5342 Election Consolidation Rules

Whenever any school district election or community college district election is scheduled to be held on the same day, in the same territory, or in territory that is in part the same, as an election or elections called to be held by any other district, city, county, or other political subdivision, the district election may be either completely or partially consolidated with the election or elections pursuant to Part 3 (commencing with Section 10400) of Division 10 of the Elections Code. The consolidation may be effected by the officer conducting the election upon receipt of resolutions from two or more political subdivisions whose boundaries are totally or partially the same territory calling elections to be held on the same day if the resolutions are delivered to the officer conducting the election at least 88 days prior to the date of the election. (Amended by Stats. 1994, Ch. 923, Sec. 15. Effective January 1, 1995.)
