§ 48264 Truancy Enforcement Authority

Key Takeaways

  • •If a kid is supposed to be in school but is out without a good reason, certain people can take them back to school or hold them temporarily.
  • •This can happen during school hours and only in the area where the kid lives or goes to school.
  • •The people who can do this are school staff, police officers, or probation officers.

Example

A 12-year-old kid skips school and is found hanging out at the park during school hours.

A police officer sees the kid and asks why they're not in school. If the kid doesn't have a good reason, the officer can take them back to school or hold them until a parent or guardian is contacted.
