§ 45265 Shared Personnel Director Contracts

Key Takeaways

  • •Small school districts or offices with 100 or fewer workers can share a personnel director with another school district, city, or county if most workers agree.
  • •The sharing agreement can last up to 2 years and can be renewed for another 2 years if most workers still agree.
  • •If the district or office grows to more than 100 workers, they must follow the usual rules for hiring a personnel director.
  • •The agreement ends automatically if the district reorganizes and the contract conflicts with certain laws.

Example

A small school district with 80 employees wants to save money by sharing a personnel director with a nearby city.

If most of the 80 employees agree, the school district can make a 2-year deal with the city to share their personnel director. After 2 years, if everyone is happy, they can renew the deal for another 2 years. But if the school district hires more people and grows to 105 employees, they can’t renew the deal and must hire their own personnel director.

§ 45265 Shared Personnel Director Contracts

Notwithstanding the provisions of Section 45264, the personnel commission, in a school district or a county superintendent of schools office employing 100 or fewer classified employees, may, with the consent of a majority of the classified employees, contract for the services of a qualified personnel director with another school district having the merit (civil service) system, or a city or a county governmental agency if the city or county has a civil service system for the management of its employee personnel. Such a contract shall be for not more than two years and may be extended, with the approval of a majority of the classified employees, for additional periods not to exceed two years at one time. If at the end of any contract period the district or county superintendent’s office is employing more than 100 classified employees, the personnel commission shall then comply with the provisions of Section 45264. A contract approved under the provisions of this section shall become null and void in the event of district reorganization when the provisions of the contract, if continued in force would supersede or be in conflict with the provisions of Sections 45119 or 45120. (Enacted by Stats. 1976, Ch. 1010.)
