§ 14002 School Program Funding Appropriation

This law tells the state how to set aside money each year for a list of education programs and what to do if the money needed looks like it will be more than 89% of the state’s education budget.

Key Takeaways

  • •When the Superintendent certifies the amount needed, that money is taken from the General Fund and put into the State School Fund.
  • •The calculated amounts become final after the second principal apportionment in the fifth fiscal year.
  • •If the needed money is over 89 % of the education budget, the Director of Finance must cut inflation adjustments by at least the projected growth rate and report the cuts before the budget is passed.

Example

A school district looks at next year’s budget and sees it will need $12 billion for the programs listed in the law, but the total education budget is only $13 billion (about 92%).

Because the needed amount is over 89% of the education budget, the Director of Finance must cut the inflation‑adjustments for certain programs by at least the projected growth rate, and then report those cuts to the Legislature before the budget is signed.

How to Calculate

Reduction % = max(0, Projected Growth Rate) (and Reduction % ≥ Other Reduction %)

  1. Figure out the total amount needed for the programs in subdivision (b) for the upcoming fiscal year.
  2. Compare that amount to 89 % of the General Fund + Education Protection Account revenues. If it is higher, you must calculate a reduction.
  3. Determine the projected growth rate of the minimum amount required by Section 8 of Article XVI of the California Constitution.
  4. Set the reduction percentage to the larger of 0 or that projected growth rate.
  5. Make sure this reduction percentage is not smaller than any other reduction percentage required under paragraph (A).
  6. Apply that percentage to the inflation or cost‑of‑living adjustments for the programs listed in paragraph (B).

The projected need is $12 billion, the education budget is $13 billion, so 12 billion ÷ 13 billion = 92 % (which is > 89 %). The projected growth rate for the minimum required amount is 2.5 %.

Result: Reduction % = max(0, 2.5 %) = 2.5 %. The inflation adjustments for the listed programs are cut by 2.5 % (or more if another required reduction is higher).
