§ 2202 Penalty Addition And Reduction

This law says that any fine set by sections 2200 or 2201 is added on top of any court order, lawsuit for damages, or other legal action against a corporation or its leaders, and a court can lower or pause the fine if the mistake was accidental or understandable.

Key Takeaways

  • •Penalties from sections 2200 or 2201 are added to any other legal remedy like injunctions or damage suits.
  • •Courts may lower, waive, or suspend the penalty if the failure was accidental or excusable.
  • •The rule applies to the corporation itself and its directors or officers.

Example

A company forgets to file a required safety report and gets a fine under section 2200. The injured worker also sues the company for damages. The court can decide to cut the fine in half because the missed filing was due to a computer glitch.

The fine is extra to the worker's lawsuit, but the judge can reduce the fine since the company's failure was not on purpose.
