§ 12699 Involuntary Dissolution Transition Rules

This rule says that new rules (Chapter 15 and 17) are used for forcing a company to close if the case starts on or after Jan 1 1984, while old rules still apply to cases that began before that date even if they keep going after Jan 1 1984.

Key Takeaways

  • •New rules apply to company‑closure cases that start on or after Jan 1 1984.
  • •Old rules still control cases that started before Jan 1 1984, even if they continue after that date.
  • •The switch‑over date is Jan 1 1984; it’s the line that decides which set of rules to follow.

Example

A state agency starts a case in 1985 to shut down a company because it broke the law.

Because the case began after Jan 1 1984, the new Chapter 15 and Chapter 17 rules are used to decide what happens to the company.
