§ 9552 Payment Bond Claim Requirements

Key Takeaways

  • •If a contractor doesn't provide a payment bond (like a promise to pay) for a public project, the government won't pay them.
  • •Workers or suppliers who aren't paid can ask for their money directly using a special notice.
  • •This rule makes sure people get paid even if the contractor forgets the bond.

Example

A school hires a company to build a new playground. The company doesn't give the school a payment bond like they were supposed to.

The school won't pay the company for the work. But if the company didn't pay the workers who built the playground, those workers can ask the school to pay them instead.
