§ 9300 Preliminary Notice Requirements

Key Takeaways

  • •Before you ask for money or stop a payment on a big project, you usually have to tell the government and the main contractor first.
  • •Workers (like laborers) don’t have to give this notice.
  • •If you have a direct deal with the main contractor, you also don’t have to give this notice.
  • •If you don’t follow this rule, your request for money or to stop payment might not work.

Example

You’re a small company that supplied materials to a subcontractor for a school project.

Before you can ask the school or the main contractor for money, you have to tell them first that you’re working on the project. If you don’t tell them, they might not have to pay you.
