§ 9510 Stop Payment Notice Release

Key Takeaways

  • •If someone tries to stop payment on a claim but the case gets thrown out, the money will be released.
  • •If the person who filed the claim loses in court, the money will be released.
  • •The stop payment only works until the case is decided.

Example

A contractor doesn't get paid for fixing a school's roof and files a stop payment notice. The school refuses to pay, so the contractor sues.

If the contractor loses the case or drops it without a good reason, the school will get the money back that was being held.
