§ 9364 Public Contractor Release Bonds

Key Takeaways

  • •If someone working on a public project isn't paid, they can send a 'stop payment notice' to freeze money owed to the main contractor.
  • •The main contractor can give the public entity a special bond (like a promise to pay) instead of having the money frozen. This bond must be worth 125% of the unpaid amount.
  • •Once the public entity gets this bond, they can't freeze the main contractor's money anymore.
  • •The company that provides the bond is responsible for paying the unpaid worker if they win in court.

Example

A painter works on a new school but doesn't get paid $10,000. They send a stop payment notice to freeze the school's payment to the main contractor.

The main contractor can give the school a bond worth $12,500 (125% of $10,000) to unfreeze the money. If the painter sues and wins, the bond company must pay the $10,000 plus court costs.
