§ 9360 Contractor Payment Protection Rules

Key Takeaways

  • •If no one tells the boss to stop paying, the boss can pay the main worker.
  • •Even if someone says stop paying, the boss can still pay the main worker the extra money that’s not part of the problem.
  • •The boss can also pay extra for things like interest or court costs if there’s a fight about the money.

Example

A company hires a builder to fix a school. Another worker says the builder didn’t pay them, so they tell the company to stop paying the builder.

The company can still pay the builder the extra money that’s not part of what the worker is asking for. They can also pay a little more if they think there might be extra costs like interest or court fees later.
