§ 6716 Common Area Maintenance Responsibility

Key Takeaways

  • •The association (like a homeowners' association) is usually responsible for fixing and maintaining shared areas, like pools or parks, unless the rules say otherwise.
  • •Each homeowner is responsible for taking care of their own home and any areas only they use, like a private balcony.
  • •If the association needs to fix something in a shared area and you have to move out temporarily, you have to pay for your own place to stay during that time.

Example

Imagine you live in a condo with a shared gym. The gym's roof gets damaged, and the association decides to fix it. While they're fixing it, the gym is closed, and you can't use it.

The association will pay to fix the gym's roof because it's a shared area. But if you have to stay somewhere else because of the repairs, you have to pay for your own hotel or temporary place.
