§ 6652 Common Area Access Rights

Key Takeaways

  • •If you own a condo or a home in a planned community, you have the right to walk or drive through shared areas like hallways, roads, or parks to get to your place.
  • •You can also use these shared areas to support your home, like if you need to fix something that goes through the common area.
  • •These rules apply even if the shared areas are owned by everyone together or by the homeowners' association.

Example

You live in a condo and need to carry groceries from the parking lot to your front door.

You can walk through the shared hallway or courtyard to get to your condo, even if someone else owns that space with you. The law says you have the right to use these areas to get to your home.
