§ 4510 Member Access To Property

Key Takeaways

  • •You can't be stopped from going into your own home or property by the people in charge of your building or neighborhood.
  • •They can't block the paths or doors you use to get to your place, even if those paths are shared with others.
  • •This rule can be changed only if a court or an arbitrator (a person who helps solve arguments) says it's okay.

Example

You live in a condo building, and the homeowners' association is mad at you because you didn't pay a fee. They try to block you from using the main entrance to get to your condo.

The association can't do that. You have the right to go to your own home, and they can't stop you from using the shared areas to get there unless a court says they can.
