§ 6564 Separate Interest Definitions

Key Takeaways

  • •A 'separate interest' is the part of a property you own or have the right to use, like your apartment in a condo or your house in a planned neighborhood.
  • •If walls, floors, or ceilings are part of your separate interest, you own the inside surfaces (like paint, doors, and windows), but the rest (like the outside of walls) is shared with everyone.
  • •You can own your separate interest forever, for a set number of years, or even just for your lifetime.

Example

You buy an apartment in a condo building.

You own the inside of your apartment, like the walls, floors, and windows inside your unit. But the outside of those walls and the hallways are shared with everyone in the building.
