§ 5680 Lien Priority For Assessments

Key Takeaways

  • •If you don't pay your fees (like HOA fees), a lien can be put on your home.
  • •This lien comes before other liens that are added after the notice of unpaid fees.
  • •Sometimes, the rules can say this lien comes after other debts, like a mortgage.

Example

You own a house in a neighborhood with an HOA, and you stop paying your HOA fees.

The HOA can put a lien on your house for the unpaid fees. This lien will be paid before other debts that come after the notice, unless the HOA rules say otherwise.
