§ 5673 Board Approval Of Liens

Key Takeaways

  • •Only the board can decide to record a lien for unpaid fees, not someone else.
  • •The board must vote on it in a meeting where everyone can see.
  • •Most of the board must agree to do it.
  • •They have to write down the vote in their meeting notes.

Example

Your neighborhood has a rule that everyone must pay a fee every month to keep the park clean. If someone doesn’t pay, the neighborhood leaders want to put a lien on their house.

The leaders must have a meeting where everyone can watch, and most of them must agree to put the lien. They can’t let someone else, like a manager, decide this. They also have to write in their meeting notes that they voted to do it.
