§ 2855 Arbitration Award Surety Protection

Key Takeaways

  • •If someone loses in arbitration, the decision is only against them, not their backup payer (like a guarantor or surety).
  • •The backup payer can't be forced to pay just because the main person lost in arbitration.
  • •This rule is just applying old laws to arbitration cases.

Example

You hire a contractor to fix your roof, and they promise to pay if they mess up. Later, you have a problem and take the contractor to arbitration. The arbitration says the contractor must pay you $5,000.

The contractor has to pay you $5,000, but their backup payer (like an insurance company or guarantor) doesn’t automatically have to pay. You’d have to go after them separately if the contractor doesn’t pay.
