§ 2832 Principal As Surety Proof

Key Takeaways

  • •If someone looks like the main person responsible (like signing a loan), they can later say they were just a backup (a 'surety').
  • •They can’t do this if others already trusted them as the main person and made decisions based on that.
  • •They don’t have to prove the lender knew they were just a backup.

Example

Your friend signs a loan for a car, and everyone thinks they’re the main person paying it back. Later, they say, 'I was just helping—ask the real person to pay!'

If the bank already gave the loan because they trusted your friend as the main payer, your friend can’t just say they were backup. But if the bank didn’t rely on them being the main person, they can clarify they were just helping.
