§ 5415 Advertising Display Regulations

Key Takeaways

  • •The state must follow federal rules for billboards near highways.
  • •Billboards can't be bigger, closer together, or brighter than the rules say.
  • •The state can't change the rules to match new federal laws without asking the legislature first.
  • •No billboards are allowed near interstate or primary highways if they break the old federal rules from 1967.

Example

A company wants to put up a big, bright billboard next to a highway.

The billboard must follow the old federal rules from 1967. If it's too big, too close to another billboard, or too bright, the state won't allow it. Even if the federal rules change, the state can't update its rules without the legislature's okay.
