§ 2367 Licensee Treatment Program Compliance

Key Takeaways

  • •If you ask to join a treatment program, you must follow the rules they give you.
  • •If you don’t follow the rules, you can be kicked out of the program.
  • •Being in the program doesn’t protect you from other punishments if you break the rules.

Example

A doctor has a problem with alcohol and joins a treatment program to keep their medical license.

The doctor must follow all the program’s rules, like going to meetings and staying sober. If they skip meetings or drink alcohol, they can be kicked out of the program. Even if they’re in the program, they can still lose their license if they mess up.

§ 2367 Licensee Treatment Program Compliance

(a) Each licensee who requests participation in a treatment program shall agree to cooperate with the treatment program designed by the committee and approved by the program manager. The committee shall inform each participant in the program of the procedures followed, the rights and responsibilities of the participant, and the possible results of noncompliance with the program. Any failure to comply with the treatment program may result in termination of participation. (b) Participation in a program under this article shall not be a defense to any disciplinary action which may be taken by the board. Further, no provision of this article shall preclude the board from commencing disciplinary action against a licensee who is terminated from a program established pursuant to this article. (Amended by Stats. 2008, Ch. 548, Sec. 12. Effective January 1, 2009.)
