§ 8104 Mental Health Records Sharing

Key Takeaways

  • •The State Department of State Hospitals must keep records that help identify people who are not allowed to have guns or explosives.
  • •If the Department of Justice asks for these records, they must get them within 24 hours.
  • •These records are only used to check if someone can legally buy or own guns, explosives, or other dangerous weapons.
  • •The records are not shared with anyone else unless it's for checking if someone can have these dangerous items.

Example

If someone tries to buy a gun, the store will check with the Department of Justice to make sure that person is allowed to have a gun.

The Department of Justice will look at the records from the State Department of State Hospitals to see if the person has a history that stops them from owning a gun. If they do, the store won't sell them the gun.
