§ 7303 Commitment Transfer Liability Shift

Key Takeaways

  • •If someone is moved to a different state hospital, the county that first sent them there might not have to pay for their care anymore.
  • •The county can ask for the old commitment papers to be canceled and new ones made for the new hospital.
  • •This change helps the county stop paying for the person's care if the state is now responsible.

Example

A person is sent to a county hospital for treatment, and the county pays for it. Later, they are moved to a state hospital where the state pays instead.

The county can ask to cancel the old papers that made them pay and get new papers for the state hospital. Now, the state pays, not the county.

§ 7303 Commitment Transfer Liability Shift

Whenever a person, committed to the care of the State Department of State Hospitals or the State Department of Developmental Services under one of the commitment laws which provides for reimbursement for care and treatment to the state by the county of commitment of the person, is transferred under Section 7300 to an institution under the jurisdiction of the department where the state rather than the county is liable for the support and care of patients, the county of commitment may have the original commitment vacated and a new commitment issued, designating the institution to which the person has been transferred, in order to absolve the county from liability under the original commitment. (Amended by Stats. 2012, Ch. 24, Sec. 187. (AB 1470) Effective June 27, 2012.)
