§ 729 Minor Battery Restitution Requirements

Key Takeaways

  • •If a kid hits someone on school property, they have to pay back the person they hurt or do community service.
  • •The judge can decide not to make the kid pay back or do community service, but they have to explain why.
  • •The judge can add other rules for the kid to follow, not just these.

Example

A student gets into a fight at school and punches another student, breaking their glasses.

The judge can make the student pay for the broken glasses or do community service, like cleaning the school. If the judge thinks it's not fair, they can say why and not make the student do it.

§ 729 Minor Battery Restitution Requirements

If a minor is found to be a person described in Section 602 by reason of the commission of a battery on school property as described in Penal Code Section 243.5, and the court does not remove the minor from the physical custody of the parent or guardian, the court as a condition of probation, except in any case in which the court makes a finding and states on the record its reasons that the condition would be inappropriate, shall require the minor to make restitution to the victim of the battery. If restitution is found to be inappropriate, the court, except in any case in which the court makes a finding and states on the record its reasons that the condition would be inappropriate, shall require the minor to perform specified community service. Nothing in this section shall be construed to limit the authority of a juvenile court to provide conditions of probation. (Amended by Stats. 1994, Ch. 146, Sec. 223. Effective January 1, 1995.)
