§ 6607 Conditional Release For Svps

Key Takeaways

  • •If a person with a mental disorder is no longer likely to commit sexual violence while being supervised and treated in the community, the Director of State Hospitals can recommend letting them out.
  • •The Director sends this recommendation to the county attorney, the person's lawyer, and the court.
  • •The court then sets up a hearing to decide if the person can be released.

Example

A person has been in a state hospital for treatment because they were deemed likely to commit sexual violence due to a mental disorder. After some time, the doctors believe they have improved and are no longer a risk.

The Director of State Hospitals can write a report saying this person is ready to be released with supervision. This report goes to the court and lawyers, and then the court holds a hearing to decide if the person can leave the hospital.
