§ 356 Minor Dependency Court Findings

Key Takeaways

  • •The court listens to all the evidence about a kid's situation.
  • •The court decides if the kid needs help or protection under the law.
  • •If the kid doesn’t need help, the case is dropped, and the kid is free to go.
  • •If the kid does need help, the court makes an official order to help them.

Example

A kid is taken away from home because their parents aren’t taking care of them.

The court listens to everyone’s side—parents, teachers, social workers—and decides if the kid is safe at home. If the kid is safe, they go back home. If not, the court orders help, like placing the kid with a relative or in foster care.

If it finds that the minor is not such a person, it shall order that the petition be dismissed and the minor be discharged from any detention or restriction theretofore ordered. If the court finds that the minor is such a person, it shall make and enter its findings and order accordingly. (Amended by Stats. 1986, Ch. 1122, Sec. 9.)
