§ 8370 Flood Control Maintenance Duties

Key Takeaways

  • •Local groups (like cities or flood control districts) must take care of flood control projects in their area.
  • •They don’t have to maintain things already handled by the state (Section 8361) or the federal government.
  • •This rule has been in place since 1943.

Example

A levee in a small town starts to crack and needs fixing.

The local levee district must repair it because it’s their job to keep flood control systems working, unless the state or federal government is already responsible for that part.
