§ 22234 District Ditch Maintenance Contracts

Key Takeaways

  • •A group of landowners (at least two-thirds) can ask a district to help fix or maintain ditches or water channels that the district doesn’t own.
  • •The district can make deals (like loans or construction contracts) to do this work if they agree it’s needed.
  • •This rule was clarified in 1963 but was already in place before that.

Example

Farmers in a small town share a ditch that brings water to their fields, but it’s getting clogged and falling apart. The ditch isn’t owned by the town’s water district.

If at least two-thirds of the farmers agree, they can ask the water district to help fix the ditch. The district can then hire workers, rent equipment, or even take out a loan to pay for the repairs.

§ 22234 District Ditch Maintenance Contracts

A district may contract to operate, maintain, or improve ditches and laterals not owned by the district upon petition of at least two-thirds of the owners of land served by such ditches or laterals. In order to carry out the purposes of this section, a district may make such contracts as the board deems necessary, including but not limited to loan and repayment contracts, construction contracts, and rental of equipment contracts. The amendment of this section made at the 1963 Regular Session of the Legislature does not constitute a change in, but is declaratory of, the pre-existing law. (Amended by Stats. 1963, Ch. 524.)
