§ 1430 Temporary Water Diversion Permits

Key Takeaways

  • •A temporary water permit can be changed or taken away anytime by the board.
  • •The permit to use water lasts only 180 days unless it's canceled earlier or says a different date.
  • •The 180 days don't count the time needed for checking, reporting, or fixing problems before or after using the water.
  • •If the permit lets you store water, the 180 days only limit how long you can take water, not how long you can use the stored water.

Example

A farmer gets a temporary permit to take water from a river for crops.

The farmer can take water for 180 days, but if it takes 10 days to set up and 5 days to report after, those days don't count toward the 180 days. The farmer can still use the stored water after the 180 days.

§ 1430 Temporary Water Diversion Permits

A temporary permit issued under this article shall not result in the creation of a vested right, even of a temporary nature, but shall be subject at all times to modification or revocation in the discretion of the board. The authorization to divert and use water under a temporary permit shall automatically expire 180 days after the authorization takes effect, unless an earlier date is specified or the temporary permit is revoked. The 180-day period does not include any time required for monitoring, reporting, or mitigation before or after the authorization to divert or use water under the temporary permit. If the temporary permit authorizes diversion to storage, the 180-day period is a limitation on the authorization to divert and not a limitation on the authorization for beneficial use of water diverted to storage. (Amended by Stats. 2019, Ch. 678, Sec. 6. (AB 658) Effective January 1, 2020.)
