§ 12844 Flood Project Recreation Guidelines

Key Takeaways

  • •This law says that when the state looks at projects to control floods or protect water areas, they should also think about fun outdoor activities people can do there.
  • •The fun activities should be things people usually do outside, like hiking or fishing, and should not get in the way of the project's main job.
  • •The main goal is to make sure these projects can be used by everyone for fun, as long as it doesn’t mess up the project’s other jobs.

Example

A new dam is being built to stop floods in a town. The town wants to add a park nearby with picnic tables and a fishing spot.

The law says the state should think about adding the park and fishing spot because these are fun outdoor activities that people can enjoy. But they have to make sure the park doesn’t stop the dam from doing its job of controlling floods.

In order to guide state agencies in their review of proposed flood control and watershed protection projects, it is the intent of the Legislature that recreational purposes shall include, but be not limited to, those recreational activities normally and usually associated with the out-of-doors which make project land and water areas available for use by the general public and are consistent with the operation of the project for other purposes.
