§ 99569 Public Transit Labor Proposals

Key Takeaways

  • •Any new ideas or plans from workers or bosses about work stuff must be shared in a public meeting and written down for everyone to see.
  • •Before talking about these ideas, there must be time for the public to learn about them and say what they think at a meeting.
  • •After hearing what the public thinks, the boss must pick a plan in another public meeting, and can change the plan based on what people said.
  • •If new topics come up later, they must be shared with the public within 24 hours, and if there’s a vote, the results must also be shared within 24 hours.

Example

Imagine the bus company wants to change the bus drivers' work hours. They have to share this idea in a public meeting first.

The bus company can’t just decide on their own. They have to tell everyone about the idea, let people say what they think, and then make a final decision in another public meeting. If they later want to talk about giving drivers more breaks, they have to tell the public about this new topic within a day.

(a) All initial proposals of exclusive representatives and of transit district employers, that relate to matters within the scope of representation, shall be presented at a public meeting of the transit district employer and thereafter shall be public records. (b) Meeting and conferring shall not commence on an initial proposal until a reasonable time has elapsed after the submission of the proposal to enable the public to become informed and the public has the opportunity to express itself regarding the proposal at a meeting of the transit district employer. (c) After the public has had the opportunity to express itself, the transit district employer shall, at a meeting that is open to the public, adopt a proposal, including any changes to its initial proposal that the transit district employer deems appropriate based on the public’s comments. (d) New subjects of meeting and conferring arising after the presentation of initial proposals shall be made public within 24 hours. If a vote is taken on a new subject by the transit district employer, the vote on the subject by each member voting shall also be made public within 24 hours. (e) The board may adopt regulations for the purpose of implementing this section, which are consistent with the intent of the section, that the public be informed of the issues that are being met and conferred upon and have full opportunity to express their views on the issues to the transit district employer, and to know of the positions of the transit district employer.
