§ 98051 District Boundary Review Authority

Key Takeaways

  • •The local government draws lines to decide which areas are part of a special district.
  • •A special group can change these lines to make sure only areas that benefit are included.
  • •They can't split a city or town so that part is in the district and part is out.

Example

A small town wants to create a special district to improve parks.

The town draws lines to show which neighborhoods are in the district. A special group checks these lines and can change them to make sure only neighborhoods that will actually use the parks are included. They can't split the town in half, so the whole town is either in or out.

§ 98051 District Boundary Review Authority

The board of supervisors shall submit the boundaries for the district as described in the resolution or petition to the local agency formation commission for review. The local agency formation commission shall have the authority to adjust the boundaries so as to exclude areas which would not receive reasonable benefit from inclusion in the district, but no incorporated area shall be divided so that part of it is within and part outside the district.
