§ 95651 Labor Union Representation Disputes

Key Takeaways

  • •If workers and a company can't agree on whether a union represents most workers, the State Conciliation Service steps in to decide.
  • •The State Conciliation Service holds a public meeting to figure out which workers can vote in a union election.
  • •Once a union is officially chosen, no one can question if they still represent the workers for at least one year or until the work contract ends, whichever is later.

Example

A group of factory workers wants to form a union, but the factory owner says not enough workers support it.

The workers and the owner can't agree, so they go to the State Conciliation Service. The Service holds a meeting and decides which workers can vote. If the union wins the vote, no one can challenge the union for at least a year or until the work contract ends.

§ 95651 Labor Union Representation Disputes

If there is a question whether a labor organization represents a majority of employees or whether the proposed unit is or is not appropriate, such matters shall be submitted to the State Conciliation Service for disposition. The State Conciliation Service shall promptly hold a public hearing and may, by decision, establish the boundaries of any collective bargaining unit and provide for an election to determine the question of representation. Provided, however, any certification of a labor organization to represent or act for the employees in any collective bargaining unit shall not be subject to challenge on the ground that a new substantial question of representation within such collective bargaining unit exists until the lapse of one year from the date of certification or the expiration of any collective bargaining agreement, whichever is later. (Added by Stats. 1965, Ch. 1835.)
