§ 8285 Fraudulent Business Enterprise Representation

Key Takeaways

  • •If you lie about your business being owned by women, minorities, or LGBT people to get big contracts from utility companies, you can be fined up to $5,000 or go to jail for up to a year.
  • •If you lie about your business being owned by disabled veterans to get big contracts, you’ll get punished based on another law (Military and Veterans Code Section 999.9).
  • •This applies to big companies making over $15 million a year in California, especially utility companies like electric, gas, or phone companies.
  • •If a company lies, not just the company but also the bosses or workers who made the false claim can be punished.

Example

A construction company says it’s owned by a woman to win a big contract with an electric company, but it’s actually owned by a man.

The company and the person who lied could be fined up to $5,000 or even go to jail because they pretended to be a women-owned business to get the contract.
