AI SummaryVerified

§ 7536 Railroad Crossing Land Acquisition

Key Takeaways

  • •Railroads and roads can cross each other by going over, under, or at the same level.
  • •If building the road or railroad requires moving dirt or changing the path, the company can take extra land if needed.
  • •If the company can't buy the land they need, they can force a sale (but must pay the owner fairly).
  • •Once the company pays for the land, it becomes theirs.

Example

A train company wants to build tracks that cross a busy road, but the road is too high and needs to be lowered.

The company can dig into the ground to lower the road so the train can pass over it safely. If they need extra land to do this, they can buy it or force a sale if the owner refuses (but they must pay a fair price).

§ 7536 Railroad Crossing Land Acquisition

Whenever the track of a railroad crosses another railroad or a highway, such railroad or highway may be carried under, over, or on a level with the track, as is most expedient. Where an embankment or cutting necessitates a change in the line of such railroad or highway, the corporation may take such additional lands and material as are necessary for the construction of the road or highway on the new line. If the necessary lands cannot be had otherwise, they may be condemned as provided in Title 7, Part 3 of the Code of Civil Procedure, and when compensation is made therefor the lands become the property of the corporation. (Enacted by Stats. 1951, Ch. 764.)
