§ 30909 Bond Purpose Change Election

Key Takeaways

  • •If the government decides the original plan for bond money is not a good idea anymore, they can change it.
  • •They need a big vote (two-thirds of the board) to agree to this change.
  • •Then, they must ask the voters in the area if they agree to use the bond money for something else.
  • •The process to ask the voters is the same as when they first asked for the bonds.

Example

A city planned to use bond money to build a new park, but later found out the land is too expensive.

The city board can vote to change the plan and ask voters if they want to use the money to fix roads instead.

§ 30909 Bond Purpose Change Election

Whenever the board deems that the expenditure of money for the purposes for which the bonds were authorized by the voters is impractical or unwise, it may, by ordinance adopted by a vote of two-thirds of all members of the board, so declare and call an election to be held in the district for the purpose of submitting to the qualified voters thereof the proposition of incurring indebtedness by the issuance of such bonds for some other purposes or, in the case where bonds have been sold, the proposition to use the proceeds for some other purposes. The procedure, so far as applicable, shall be the same as when a bond proposition is originally submitted. (Added by Stats. 1964, 1st Ex. Sess., Ch. 62.)
