  • •People can ask to create a special district by signing a petition instead of going through a long process.
  • •At least 10% of the voters in the area must sign the petition.

  • •If the whole area of a public agency is included, just naming the agency is enough to describe it.

They can collect signatures from at least 10% of the voters in their area. The petition must describe the boundaries of the new district and include at least two public agencies, like the local school district and the city park department. If they include the entire school district, they just need to write the name of the school district in the petition.

§ 13453 Petition For District Formation

Instead of procedure by resolutions, a petition may be filed with the secretary of a district signed by voters within the proposed special district equal in number to at least 10 percent of the total vote cast. The boundaries of the proposed special district shall be described in the petition and shall include at least two public agencies or portions thereof. A statement of the name of any public agency constitutes a sufficient and legal description of the territory thereof if the entire area of the agency is included. (Amended by Stats. 1977, Ch. 128.)
