§ 13452 Special District Creation Procedures

Key Takeaways

  • •Before creating a special district for sewage or trash handling, at least half of the local government groups in the area must agree it's needed.
  • •The area for the new district can include land outside a city or town if it's part of a bigger utility district.
  • •If a whole city or town is included, the agreement can just name the place instead of describing its borders.
  • •Copies of the agreements must be sent to the district secretary.

Example

A group of towns wants to create a special district to handle trash collection together.

At least half of the towns must vote and agree that this is needed. If one town is entirely part of the new trash district, they can just say the town's name in the agreement instead of drawing its borders. They then send copies of their agreements to the district secretary.

Resolutions shall first be passed by the legislative bodies of half or more, but of not less than two, of the public agencies, all or any part of the area of which it is intended to include in the proposed special district, declaring that the public interest or necessity demands the creation of a special district for sewage disposal or solid waste resource recovery purposes and describing its boundaries. The boundaries of the proposed special district may include territory outside any such public agency if the territory is within the area of the municipal utility district. When the entire area of any public agency is to be included in the special district it may be described in the resolutions by name. Certified copies of the resolutions shall be filed with the secretary of the district. (Amended by Stats. 1977, Ch. 128.)
