§ 11581 Municipal Utility District Formation

If at least half of the public agencies that would be in a new utility district agree, they can officially decide to create that district and give it a name.

Key Takeaways

  • •Half or more of the agencies must agree.
  • •They do this by passing a resolution.
  • •The resolution says the district is needed for the public and gives it a name.

Example

Three neighboring towns want to share a new water system. Two of the towns' councils vote and pass a resolution saying the water system is needed for the public.

Because two out of three (more than half) agreed, the law lets them officially start the new water district and call it the "River Valley Municipal Utility District."
