§ 101168 Officer Oath Filing Requirement

This law says anyone appointed as an officer under this article has to swear an oath and file it within 10 days of being appointed and before they start doing their job.

Key Takeaways

  • •New officers must take an oath of office.
  • •The oath must be filed within 10 days of appointment.
  • •The oath must be taken before any official duties start.
  • •The oath follows the rules in Sections 1360 and 1363 of the Government Code.

Example

John is named a new fire department captain on March 1. He must take his oath and file it by March 11, and he can’t start working as captain until he has done that.

Because the law requires the oath to be taken and filed within 10 days and before any official duties begin, John must wait until he has completed the oath before he can act as captain.
